These terms apply when you use nowmerce.com, create an account or buy from Nowmerce ("we", "us"). By using the site you agree to them. Please also read our Privacy Policy and Returns & Refunds policy, which form part of these terms.
Your account
- You must be 18 or older to create an account or place an order.
- Please give accurate details and keep them up to date, especially your phone number and delivery address.
- Keep your password private. You're responsible for what happens on your account. If you think someone else has used it, tell us straight away.
- We may suspend or close an account that's used for fraud, abuse, or to break these terms.
- You can ask us to close your account at any time.
Products and prices
- Prices are in Jamaican dollars (J$). Some products show "Pricing coming soon" until we confirm a price.
- We try to describe and photograph every product accurately, but colours and sizes can look slightly different on your screen. Some photos come from the manufacturer.
- Availability isn't guaranteed until we confirm your order.
- If we make a mistake with a price or description, we'll tell you before we take your money or dispatch your order. You can then go ahead at the correct price or cancel.
Orders and payment
- Online checkout opens in January 2027. Until then, and after, you can order by contacting us.
- Placing an order is an offer to buy. Your order is accepted when we confirm stock and delivery with you.
- We accept bank transfer and cash. Card payments are coming later.
- For bank transfers, we dispatch once the payment has reached our account.
- We may cancel an order, with a full refund of anything you've paid, if the item turns out to be unavailable or we suspect fraud.
Delivery
- We deliver across Jamaica by local courier or Knutsford Express.
- The delivery charge is confirmed with you before dispatch, and is added to your order.
- Delivery times are estimates. We'll keep you updated if there's a delay.
- Please check your order when it arrives, and tell us about any damage within 3 days.
Returns and refunds
You have 3 days from delivery to ask for a return. Full details are in our Returns & Refunds policy.
Selling on Nowmerce
From January 2027, other businesses and individuals will be able to sell on Nowmerce. Sellers will agree to separate seller terms. When you buy from another seller, we'll show clearly who is selling the item.
Using the site
Please don't misuse Nowmerce. For example, don't:
- try to break into accounts or parts of the site you shouldn't access,
- send spam or false sign-ups, or overload the site with automated requests,
- copy our site, photos or descriptions for your own business without permission,
- use the site for anything illegal.
Our content
The Nowmerce name, logo and site design belong to Nowmerce. Product names and brands belong to their owners.
Liability
- We aren't responsible for losses we couldn't reasonably have foreseen, or for delays caused by events outside our control, such as severe weather or courier disruption.
- Where the law allows, our responsibility for any order is limited to the amount you paid for it.
- Nothing in these terms limits your rights under Jamaican law, including the Consumer Protection Act.
Changes to these terms
We may update these terms as Nowmerce grows. We'll change the date at the top, and the terms in place when you place an order apply to that order.
Law
These terms are governed by the laws of Jamaica, and the courts of Jamaica handle any disputes.
